This Privacy Policy (“Policy”) addresses how The Lighting Exchange collects, uses, and discloses the information we collect in connection with your use of The Lighting Exchange website at https://lighting.exchange (the “Website) and the platform, which requires a user account (the “Platform”). References in this Policy to “you” or “your” means you, the individual user of The Lighting Exchange. Whenever we refer to “we,” “our,” or “us,” we mean The Lighting Exchange.


What Information Does The Lighting Exchange Collect?


The information we collect from you in connection with your use of the Website depends upon your interactions with us.


  • From the main page on our Website, if you choose to click on the button and hyperlink labeled “Manufacturer Sign Up” or “Agency Sign Up,” your default email program will display a blank email message that has been pre-populated with our email address info@lighting.exchange, which will enable you to inquire with us about signing up on the Platform as a Manufacturer or Agency, as applicable. In each instance, we will collect your email address, name, and the content of your message along with any other information that you choose to provide us in your email.


  • If you navigate to the Education page on our Website, you have the option to “Request Agency Info” or to “Request Manufacturer Info.” In both instances, if you click on either button and hyperlink, your default email program will display a blank message that has been pre-populated with our email address: info@lighting.exchange, which will enable you to inquire of us regarding the information that you are interested in. In each case, we will collect your name, email address and the content of any message along with any other information that you choose to provide us in your email.


  • The Education page of the Website will also enable you to view and enroll in Featured Courses provided by a third party lighting manufacturer. Should you choose to enroll for a particular course, your information will be collected by the third party offering that course and will be subject to the terms and conditions of that third party’s privacy policy.


  • The LEX News page of the Website contains lighting news, which are compiled from third party websites. In the event that you choose to follow the button and hyperlink to the full

    story, you will be re-directed to a third party website. Please consult the section of this Policy titled “Third Party Hyperlinks” for more information on third party hyperlinks.


  • Should you choose to visit the Login page of our Website, we will collect your email and password in connection with authenticating your credentials to enable you to log into the Platform. If you have difficulty logging in to the Platform and choose to select the “Forgot Password” hyperlink, we will collect your email address in order to send you instructions on how to reset your password.


The Lighting Exchange Platform


  • For purposes of registering you with an independent user account, we will collect your name and email address. Once a user’s credentials are authenticated, the user is taken to the Platform’s dashboard. From the Dashboard, a user is able to explore a variety of options and functions based upon whether the user has an Agency or Manufacturer account.


  • For each Agency and Manufacturer profile, we profile the company name, website address, physical address, and a phone number.


  • The Product page within the Platform permits a user to rearrange the order in which published products are presented on Agency sites. Information about your desired arrangement of products is collected and is then capable of being pushed out to Agency websites. The user has the capability to edit a product listing, including changing the text of the description. The user also has the option to mark a particular product description as a “Draft” to return to at a later date or the user may “Discontinue” that product. We collect the text of any edit to a description that you input into the system in connection with fulfilling your request.


  • From within the Platform, a user has the capability to upload, delete, edit, and feature Application Photos, Product Literature, and Videos. This media can then be pushed out to Agency websites. The user also has the option to mark any Application Photo, Product Literature, or Video as a “draft.” We collect the information you wish to upload and any options that you select on the Platform for that media for purposes of fulfilling your desired request.

  • Our Advertisement Banners functionality within the Platform enables a user to edit, mark as a draft, feature, and un-feature certain banner advertisements that are pushed to Agent websites. In each case, the information we collect is for purposes of fulfilling the user’s request.


  • The Performance Reports function enables a user to build a performance report based upon Company, Products, Categories, Banners, and Presentations & Training, which are built based upon aggregated statistics that we collect using cookies to make available to our users.


  • From within the Platform, you may choose to use our chat functionality, which we make available to you through a third party service provider. If you choose to use the chat function, our third party service provider will collect your email address and the content of any message for purposes of displaying your communication to other users who are also utilizing the functionality.


  • Our Platform utilizes internet cookies. For more information on our use of internet cookies and the internet we collect, please visit the section of this Policy titled “Internet Cookies.”


Agency Websites

An Agency has the capability to integrate content (i.e. products, literature, application photos, videos, etc.) from a Manufacturer utilizing The Lighting Exchange Platform. In conjunction with this integration, The Lighting Exchange deploys third party cookies from the Agency’s website, which are used for analytical purposes and specifically, to collect statistical information about the popularity of certain content and features. These statistics are used to produce reports to enable a Manufacturer to measure the success of their efforts utilizing the Platform. LEX Online Events

In conjunction with your participation in a LEX Online Event (collectively, the “LEX Services”), we will collect aggregated and anonymized information about and monitor your interactions with LEX Services’ content, exhibitors, agent resellers, and other participants during the Event (collectively, “LEX Event Information”). The LEX Services recommends that participants and exhibitors utilize a web camera and microphone in connection with an Event. This technology enables exhibitors to

present content to an audience and the participants to engage with exhibitors, agent resellers, and other participants during the Event. We collect the images and audio that you provide us with in order to make this content available to other users within the Event. We do this with your consent and as a condition of your participation in the Event.


How Does The Lighting Exchange Use the Information It Collects? We use the information we collect from you in the following ways:


  • When you contact us to sign-up as a Manufacturer, Agency or request information about a Manufacturer or Agency, we use the information we collect from your email message to us to respond to your inquiry.


  • If you register for an account with our Platform, we use the information we collect from you for purposes of creating your account, authenticating your credentials each time you log into the Platform, for account administration, and support.


  • While using the Platform, we collect information in connection with your use of functions to fulfill your given request. For example, if you choose to engage the edit function under the Application Photos, Product Literature or Video pages of the Platform, we will collect your edit and mark it as a “Draft,” or we will update the media or text in accordance with the settings that you choose. If you choose to reorder Application Photos, Product Literature, Advertisement Banners, Videos, or Published Products, we will collect your desired order and reshuffle the items accordingly. In the event that you choose to upload an image, video, or other content, we collect this information for purposes of making it available to you on the Platform to use in accordance with the functions we make available to you to use on the Platform.


  • When you use the chat functionality that we make available through the Platform, The Lighting Exchange’s third party service provider will use the content of your message for purposes of displaying that message to other users within the chat application.


We use the LEX Event Information that we collect for purposes of generating reports for our Customers regarding participation metrics of the Event and for our internal business purposes. We use this information to combat against fraud and to detect, troubleshoot, and resolve any issues

with the LEX Services. We also use the LEX Event Information to optimize and improve the LEX Services. As noted in the section on the data collected during LEX Online Events, we use the images and audio provided by exhibitors, agent resellers, and participants for purposes of making such data available to the other attendees of the Event.


Internet Cookies

Our Website and Platform utilize internet cookies, which are small data files that are transmitted from our Website and Platform to your computing device through your internet web browser. Internet cookies provide us with a mechanism to collect certain information about you, including your computing device type, the name of your internet browser, the domain of your internet service provider, your browser language preference, internet browsing history, the date and time of your visit to the Website and the duration of your browsing session on the Website.


We use internet cookies in connection with use of our Platform. An internet cookie is utilized in connection with authenticating each user’s login credentials to grant you access to the Platform. We use cookies in connection with the Platform to keep track of what content and functionality is most popular on the Platform, to detect, troubleshoot, and resolve technical issues on our Website and Platform, to help combat against fraud, malicious and criminal activities on the Website and Platform in connection with the use of the services that we offer. We also use internet cookies to help measure the effectiveness of our Platform and to improve and optimize the Platform for our customers.


Agency websites integrate Manufacturer’s content (i.e. products, literature, application photos, videos, etc.) from The Lighting Exchange Platform. In conjunction with this integration, The Lighting Exchange deploys third party cookies from the Agency’s website, which are used for analytics and collect statistical information about the popularity of certain content and features, which permits a Manufacturer to measure the success of their efforts utilizing the platform.


Your Options for Internet Cookies

Depending upon the type of internet web browser that you use to visit the Website and log into the Platform, you may have the option to change your browser settings with respect to how your browser handles internet cookies. Many of the most popular internet browsers contain functionality that enables users to reject or block internet cookies from being deployed to their computing device. For additional information about the settings that may be available to you, please consult your internet browser’s help file. Please be advised that should you choose to block or reject cookies that portions of the Website may not properly display for you and that you will be unable to log into or use the Platform because cookies are necessary in order to authenticate your credentials.


Does The Lighting Exchange Share My Information with Third Parties?

The Lighting Exchange does not sell or lease any personal information about you, such as your name, email address, telephone number or any other contact details. In connection with providing the Website and Platform to you, we utilize a number of third party service providers, including for website design and hosting, cloud storage, email, software, and marketing services. We only disclose your information to these third party services providers where such disclosure is necessary for those service providers to render their services to us. We prohibit our service providers from using your personal information for any other purposes except to provide their services to us.


Notwithstanding the foregoing, we reserve the right to disclose your information if disclosure is required, as determined in our sole discretion, in order for The Lighting Exchange to comply with a legal obligation imposed on us, including without limitation, in response to a subpoena, court order, legal process, or a request from a judicial or governmental authority. Further, we reserve our right to disclose your information under circumstances where disclosure is required in order for us to protect the rights, property or safety of The Lighting Exchange, its customers, users, and other third parties.


If The Lighting Exchange is sold, or a substantial amount of all of its assets are sold to a third party, or The Lighting Exchange is reorganized, or merged into another entity, the information that we maintain about you, including any personal information and information associated with your account, will be among one of the transferred assets in any such transaction with the acquiring or merging entity.


Changes to this Policy

The Lighting Exchange reserves the right to update this Policy from time to time as we deem appropriate in our sole discretion. When we revise this Policy, we will update the “Last Modified Date,” which appears at the top of this page. Updates are effective as of their posting date, unless otherwise required by applicable law. Please be advised that it is your responsibility to check this Policy on a regular basis to keep yourself advised of any changes as this Policy is legally binding upon you. In the event that we make a material change to this Policy with respect to the manner in which we collect or use information, we will provide you with notice that the Policy has changed or, where required by law, request your consent to that change. If you do not agree with a particular change or term of our Policy, then you must immediately cease your browsing session and you are no longer permitted to use the Website and Platform.


Children’s Online Privacy

The Lighting Exchange does not knowingly solicit personal information from or market to children under the age of 13 years old. For purposes of this section, personal information is information such as name, address, email address, telephone number, a personal identification number, or geolocation information capable of being used to identify physical location (i.e. street address). Users of our Website and Platform must be at least 18 years of age. If you are under 18 years of age, do not provide us with personal information. If you are the parent or legal guardian of a child

under the age of 18 and you believe that your child has provided us with personal information, please contact us using one of the contact methods listed below under the heading “Contact Us” to have your child’s information from our system.


Your Options Regarding the Personal Information You Provide The Lighting Exchange


If you would like to review, correct, update, or delete any of your personal information, such as your name, telephone number, email address, and mailing address, please contact us using the contact details included at the bottom of this page under the heading “Contact Us.” In your communication, please clearly describe your request in sufficient detail to enable us to locate your information or to contact you for additional information that may be necessary for us to verify the authenticity of your request or to locate your data to complete the request. To the extent that you have registered for an account on the Platform, you have the option of logging into your account and updating your information online.


Do Not Track Signals from Internet Browsers


We do not honor “Do Not Track” signals or requests from internet web browsers because there is no current standard that has been adopted regarding such requests.


Third-Party Hyperlinks

Our Website and Platform include hyperlinks to other websites that are not owned, controlled, or operated by The Lighting Exchange. Please be advised that The Lighting Exchange does not have control over any content, information, business or privacy practices of any third party website. We encourage you to review the privacy policy and any related terms of use in connection with your use of any third party website. The Lighting Exchange will not be responsible or liable for any content, information, business or privacy practices of any third party website.


European Union General Data Protection Regulation


Under the European Union’s General Data Protection Regulation (“GDPR”), data subjects are entitled to certain disclosures regarding their data rights. References in this Section of the Policy to “controller,” “data subject,” “personal data,” “processor,” and “supervisory authority” have the meanings given to these terms in Regulation (EU) 2016/670 of the European Parliament and of the European Council, dated 27 April 2016, on the protection of natural person with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

The personal data we collect is processed for the specific purposes set forth in this Policy. If you contact us to sign-up as a Manufacturer or Agency or to request information about manufacturer or Agency, the basis for the processing activities is your consent and our legitimate interest in responding to inquiries from users. In the event that you register to become a user on the Platform, the basis for our processing activities are based upon our contract with you in connection with providing you access to the Platform and your consent. You may withdraw your consent at any time by contacting using the information provided under the heading “Contact Us” below.


Recipients of your Personal Data


We provide your personal data to third parties, including service providers as described above in the section entitled “Does The Lighting Exchange Share My Information with Third Parties?”


Data Transfers


The Lighting Exchange is located within the United States of America. When you provide us with personal data, this information is collected and stored within the United States. While we have no intent of transferring any personal data to any other country, if such a transfer should be necessary, we will comply with applicable data privacy laws and utilize an approved mechanism for transferring such data, including the Standard Contractual Clauses, as approved by the EU Commission. We do share aggregated and de-identified statistical information with our manufacturers.


Data Retention Policy


We retain your personal data until such time as you contact us to delete this information. The only personal data that is retained is in connection with administering user accounts for the Platform.


EU Data Rights


Pursuant to the GDPR, data subject located within the EU are afforded certain data rights, including the right to request access to and rectification of the personal data that we maintain about you. In addition, data subjects have the right to request deletion of the personal data that we maintain about that data subject. Under certain circumstances, a data subject is also afforded the right to object to certain processing activities involving their personal data. A data subject is permitted to request a copy of their personal data that we maintain on that data subject, which is known as the right to data portability. To the extent that any of our processing of your personal data is based upon your consent, a data subject has the right to withdraw such consent. Finally, data subjects maintain a right to lodge or file a complaint against a data controller with a supervisory authority.

Statutory or Contractual Requirement for Personal Data


In connection with the creation of an account for the Platform, we will collect certain fields of information, which are designated as mandatory for you to provide the requested information, which is a contractual requirement and is necessary for us to collect in order to create your account and provide you with access to the Platform. If you choose against providing us any information that is marked as mandatory, we will not be able to complete the registration of your account and you will not be able to log into the Platform.
